The establishment of FIFA Clearing House SAS (FCH) is a key element of the transfer system reform package adopted by the FIFA Council in 2018 in order to promote and protect the integrity of professional football.
FCH is a payment institution established in France that acts as an intermediary in payments relating to training rewards (solidarity mechanism and training compensation) deriving from articles 20 and 21 and Annexes 4 and 5 of the FIFA Regulations on the Status and Transfer of Players (RSTP). FCH ensures that payments by new clubs are correctly distributed to training clubs. The payments are based on the final electronic player passport (EPP) and allocation statement approved by the FIFA administration.
The rights and obligations of FCH and clubs are included in the FIFA Clearing House Regulations and the Terms and Conditions of the service delivered by FCH. FCH does not charge any fee for the provision of these payment services. While providing these payment services, FCH is compliant with national and international financial and non-financial regulations, including the applicable anti-money laundering and sanction laws.
Although FCH is a 100% subsidiary of FIFA, it operates independently from FIFA. This means that the onboarding of clubs, including the compliance assessment, and the payments are done independently from FIFA.
As a payment institution licensed in France and supervised by the French Prudential Supervision and Resolution Authority ( “Autorité de Contrôle Prudentiel et de Résolution”), FCH is bound by bank secrecy, and treats clients’ documentation and information with the utmost confidentiality. FCH also complies with the European Directive GDPR on the use of personal data.
Therefore, no data nor documents shared by the client to FCH will be shared with FIFA.
FCH will have received from FIFA certain data on clubs to execute the payment. FCH will in certain limited cases report these same data back to FIFA. This will apply when FCH is required, as per the RSTP, to inform FIFA of the following events and that relate to a club, whenever:
a club fails the compliance assessment;
the new club does not make the required payment;
FCH was able to execute payments successfully for new club or training club.
FCH will then inform FIFA of the name of the club and the specific event.
